The Fields sentenced to Life...


“If you’re not outraged, then you’re not paying attention

It is hard to believe that Heather Heyer was murdered by a White Nationalist nearly two years ago. When a “proud” white nationalist got in to his car and used his car as a weapon to commit murder, injury dozens and terrorized countless others. Perhaps I’m being over the top but this needs to be said. In a clear and concise words:


Alex Fields Jr used ISIS Techniques.


White Domestic Terrorist sentenced to LIFE.


 June 28, 2018 of Alex Fields Jr Federal Indictment - Fields was sentenced to life in prison:

▪️one count of a hate crime act resulting in the death of Heather Heyer (18 U.S.C. § 249);

▪️twenty-eight counts of hate crime acts causing bodily injury and involving an attempt to kill (18 U.S.C. § 249); and

▪️one count of racially motivated violent interference with a federally protected activity (18 U.S.C. § 245(b)(2)), resulting in the death of Heather Heyer, for driving his car into a crowd of protestors on a downtown street in Charlottesville, Virginia.




And yes of course I decided to re-read Fields’ Indictment. I think what is incredibly chilling is the degree in which Fields “stalked” his prey. No hesitation  he sat and waited and then used his car like a 2 ton weapon:


As alleged in the Indictment Fields drove his car onto Fourth Street, a narrow, downhill, one-way street in downtown Charlottesville. At around the same time, a racially and ethnically diverse crowd of individuals was gathered at the bottom of the hill, at the intersection of Fourth and East 

Fields then slowly proceeded in his vehicle toward the crowd, stopped, and then observed the crowd while idling in his vehicle. Many of the individuals in the crowd were chanting and carrying signs promoting equality and protesting against racial and other forms of discrimination. With no vehicle behind him, Fields slowly reversed his vehicle to the top of the hill near the intersection of Fourth and Market streets. Fields then rapidly accelerated, ran through a stop sign and across a raised pedestrian mall, and drove directly into the crowd, striking numerous individuals, killing Heather Heyer, and injuring many others.

Fields’s vehicle stopped only when it struck another vehicle near the intersection of Fourth and Water streets. He then rapidly reversed his vehicle and fled the scene.


The “life sentence” should not come as a surprise. It is clearly detailed on page 1 of Fields’ March 27, 2019 Plea Deal and it is described in the Hate Crime statute embedded above and below;

Count 1 charges me with a Hate Crime Act Resulting in Death, in violation of 18 U.S.C. § 249(a)(l). The maximum statutory penalty is a fine of $250,000 and/or imprisonment for a term of life, plus a term of five years of supervised release. 

Counts 2 through 29 each charge me with a Hate Crime Act Involving an Attempt to Kill, in violation of 18 U.S.C. § 249(a)(l). The maximum statutory penalty for each of these counts is a fine of $250,000 and/or imprisonment for a term of life, plus a term of five years of supervised release. 


In the June 28, 2019 Fields’ Sentencing Memo - full disclosure this is not me castigating Fields’ Public Defender. As I’ve repeatedly stated some of the smartest attorneys I know (and I know a lot) are Public Defenders (PDs) - who are often  overworked, have limited resources but believe in the equal justice for all that they avail themselves to defend Defendants like Fields.

I have purposefully embedded each court filing because it is important that you have the same access to the same dataset that I’m drawing my observations from. The summary of Fields’ Memo - he relies on “his tender age” of 20 year’s old that cognitively Fields’ brain is still developing and by “imposing a life sentence - the Court would violate Fields’ 8th Amendment rights” and that it would “deprive Fields of rehabilitation” 


That Fields’ has a predisposition to severe mental illness. Given the history of Fields’ maternal grandparents. His grandfather was of the Jewish faith. That his grandparents died as a result of murder-suicide and struggled with bi-polar disorder. That Fields’ mother was in the apartment when her father killed her mother and then turned the 12 gauge shotgun on himself.

That Fields’ biological father died in a motor vehicle accident some  five months before Fields was born. Fields’ biological father also had a diagnosis of bi-polar disorder. That Fields’ mother was involved in (presumably a separate motor vehicle accident. His mother provided a letter but it remains sealed so that’s why I’m saying “presumably”) which left her paralyzed and that she requires a wheelchair for “mobility”. It is also disclosed that Fields was previously hospitalized for his mental illness.

This worst act was committed in the shadow of James’ own history and was the result of a terrible decision he made in a few minutes when he found himself trying to get back to Ohio but was instead unexpectedly blocked by a crowd of counter-protesters. (emphasis added)

The last sentence is beyond offensive - it is categorically untrue, as the Indictment and various other filings the government at no time said Fields was “unexpectedly blocked by a crowd of counter-protesters” and the “excuse” of saying he was blocked by an angry crowd is truly the very definition of mendacity.

Also Congrats Twitter  - once again you’ve proven what a cesspool your platform is - given that you’ve actually never suspended Jason Kessler’s disgusting tweets (archived). although he had the common sense to delete his tweets but the internet is forever;

Moreover in Fields’ own Sentencing Memo (I now refer you to pages 10 and 11 - which states in part:

He started using Twitter in search of a community. He quickly learned that provocative and hateful comments led to more exposure and engagement and took joy in that.

He felt more and more popular as he played to an increasingly radicalized crowd. He followed Richard Spencer, Michael Peinovich, and Identity Evropa on Twitter, had an abiding interest in racialized ideology, and heard about the August 12 Unite the Right rally through its organizers’ online recruiting campaign. Having some familiarity with some of the rally’s speakers, he formed his intention to attend, and found out that he would be able to take off of work only two days before the rally.


Even if you take Fields statement as “true” it is incredibly reckless not to address the circumstances and chain of events - of which Fields had 100% control of. He sat in his car - presumably to build up the courage to use his car as a weapon. What this map doesn’t show you is the elevation. As the Indictment discloses there’s a hill. marked by the red x. The Red Brick “road” aka W Main St is the main pedestrian thoroughfare to the Downtown Mall. It’s filled with amazing boutique shops and an excellent choice of eateries. W Main St only allows cars to move over the brick road. 


🌶SpicyFiles Sidebar🌶 Charlottesville  It is one of the best Virginia Towns. The interfaith community is rock solid - they best reflect my own values - welcoming to all. I had family that lived there for almost a decade. My family members moved out of Charlottesville about a year after this horrifying incident where Evil and Hate Descended upon one of Virginia’s welcoming cities. Like a heavy dark cloud.



The reason Fields likely picked 4th and Water Street is: the red pin is where Fields used his car to murder Ms. Heyer and dozens of others were injured but that intersection is one of the main parking garages. Hence that’s likely why there was a crowd - meaning those pedestrians were most likely walking back to their cars. That’s certainly calculated and just plain evil. Again the City of Charlottesville should not be subjugated to one horrifying day. 

That said this is probably the only time I will ever speak in a negative manner with respect to the ACLU and/or towards a sitting Federal Judge - but I certainly hope that the ACLU attorneys and Judge Conrad wake up every day with the heavy burden that their actions set off a confluence of events that caused unspeakable tragedy for so many people. This is often overlooked but the ACLU represented Unite-the-Right founder - Jason Kessler and Judge Conrad granted Kessler’s Injunction so his hate filled rally could commence. For the record I am incredibly biased and I’ll own that but I’m tired of the media giving both the ACLU and Judge Conrad a blanket pass. (Sorry for yelling)





Those are the real facts and sure could the City of Charlottesville Police and the Virginia State Police have done more? Absolutely but no one ever talks about this August 11, 2017 Order from Federal Judge Conrad. 


On a lighter note Charlottesville should not be defined by one day in August of 2017. Should you ever have the good fortune to visit this wonderful town - I highly recommend The White Spot - their Gus Berger is a thing of legends. Or try Timberlake’s Drug Store - this is where I introduced my kiddos to dipping proper french-fries into a hand spun milkshake, I believe they bring their ice cream in from Jefferson’s or South Mountain creamery. 

Also because Heather Heyer’s death should never be forgotten if you are inclined her mother established a Foundation in her name and I’m certain would appreciate spreading the Foundation’s Efforts. You can read more via Heather Heyer Foundation 

With respect to Fields’ Final Judgment and Sentencing - the Court Ruled:


Life without the possibility of release as to Ct 1;

Life without the possibility of release as to Cts-2-29 said terms to run concurrently to each other but consecutively to the term imposed in Ct. 1.

This sentence shall run concurrent to any anticipated state court sentence

I suppose Fields’ lifetime imprisonments with zero possibility of release, means justice was served but part of me thinks that so many lives were irrevocably broken that there’s no amount of justice that will bring back Ms. Heyer or miraculously heal the people Fields permanently injured. To me it doesn’t seem just or right. Nevertheless see the DOJ-OPA June 28, 2019 Release - confirming Fields was sentenced to life in prison

Case Number: CR17000296-10

What is often overlooked is Fields was Indicted on December 18, 2017 by the State of Virginia. The Grand Jury handed down a true bill during their December 2017 term. Also full disclosure some Courts in Virginia are known as Courts of No Record and various criminal proceedings can be difficult to locate (unless you have access - such as moi) but that would be using my work resources - so I had to be creative in trying to obtain  Open Source Links for his State of Virginia Criminal Matter. The City Council voted to provide the public with various filings. Henceforth any link I embed will be pulled directly from the City of Charlottesville Town’s website.

Oddly the Commonwealth “Amended” Fields Indictment. The Charlottesville Town Council uploaded this two page “amended Indictment” the same day they unsealed his Indictment - I’ve highlighted the “additional” information in the blue boxes as both victims were part of the original true bill.



I will admit I struggled with posting the Forensic Analysis - you should know that this is the scientific data of forensic evidence obtained  and it goes in to detail of the impact and death of Ms. Heyer. It is a difficult read but the evidence collected is part of the State of Virginia Criminal proceedings.

 On November 29, 2018 the Commonwealth filed the following Motion, which included two previously undisclosed Instagram Post that Fields had sent a few months leading up to August 2017

The Instagram post can be found on pages 9 and 10, respectively - and while I understand the logic in submitting this as evidence part of me also understands Fields’ strenuous objection to these images being part of the record. As one could easily argue that the Instagram Post are highly prejudicial. That said when I reviewed the attachments the hair on the back of my neck stood up.

After a semi lengthy trial on December 7, 2018 - a Virginia a jury which included seven women and five men also found Fields guilty of the following:

aggravated malicious wounding,

three counts of malicious wounding and

one count of leaving the scene of an accident causing serious injury or death.

Defendant Fields sentencing for his Virginia Criminal Case Number: CR17000296-10 is scheduled for July 15, 2019. Which should clear up any confusion in the last sentence in Fields’ Federal Case (See Federal Sentencing) - and thusly the concurrent Sentencing for both Federal and State Criminal cases. As previously noted  in some Virginia Courts they are a court of “no record” which means the only court system tends to be rather bare bones which is likely the reason the City of Charlottesville pushed updates on the Fields Case.  In the end Fields is exactly where he should be. Behind bars and will remain there for the rest of his natural life. - SpicyFiles 

Update 7/15/2019

To be clear the 419 year sentence was the State Charges as Fields was already sentenced in his Federal Criminal -Hate Crime Matter. I don’t know if this will bring closure to Ms Heyer’s family or those who were horribly injured by Alex Fields.  Sometimes the line between “just” and “right” are not always congruent- the reality is Alex Fields got in his car, he used Isis techniques and inflicted incomprehensible pain and suffering. 

The day Fields used his car like a weapon is the same day that the Virginia State Police also lost two troopers. Their helicopter crashed as they were flying to Charlottesville to assist the City. Lt. H. Jay Cullen was the pilot and trooper-pilot Berke M.M. Bates. Their deaths should not be forgotten because each of these VSP Troopers left behind wives and children.

    Thank you, Spicy. To this day I am filled with disgust at the mere mention of the words, good people on both sides. Uh, no. No, no, no. I hope that this sentencing gives Heather Heyer’s family some semblance of peace.
