The Trump Administration’s

Radical and Extreme Immigration Policies

Weak.

Dangerous.

Hints of Authoritarianism 

 

For those who have followed me, you know that I’ve been brutal and my unabashed criticism of the Trump Administration. The irony is Trump & his GOP Cabal predictably resort to: FEAR, ANGER and Immigration as their mid-term closing argument.

In July, I wrote about the R.A.I.S.E Act and I wasn’t exactly generous with my thoughts, I called it exactly what it was/is the radicalization of Trump & the GOP image of what America is, to them...WHITE.

 

I quickly followed up my R.A.I.S.E Act entry with the class action complaint filed by Temporary Protection Status entry. In nonlegalese recipients of TPS benefits flied a Federal Complaint, citing the Trump Administration’s termination of TPS was “arbitrary and capricious”

 

 

 Propaganda & Distortion of FACTS

Trump’s Desperation is dangerous and UnAmerican

 

 Maybe I’m being naive but let’s just hypothetically say, you are a Trump supporter, yet you have significant doubts and potentially “voter’s remorse”. Wouldn’t you be the least bit insulted that Donald Trump thinks you’re that stupid that you would believe his propaganda that’s drowning in racial animus? That the “guy” you voted for consistently makes false statements that he thinks so little of your intellect that he assumed this kind of “midterm political ad” would some how put the fear of God into you that you would go sprinting to a polling station and bring your entire family with you. That Trump thinks you lack the critical thinking and independence to go verify the blatant lies in this political ad or the 83 lies he uttered just yesterday at his stump speech? 

 

FACTS that Donald Trump and the GOP left out:  Luis Bracamontes, history criminal history clearly shows he was deported on numerous occasions and he re-entered America (first deportations was in 1994) under a GOP president. Yet Trump thinks his supporters are that dumb that he can blatantly lie to them in an effort prey on their fears and hate for “others” and that will be the catalyst for them to vote for the GOP next Tuesday. It’s offensive and frankly it’s vulgar. The sad reality is it just might work. Which means maybe we should all consider that America is far more racist then we want to admit. Although it was refreshing to see the following tweet from Senator Flake.

 

To say Senator Flake’s Tweet is some how a profile in courage, you understand that’s totally flawed, right? This isn’t what courage looks like. Flake has time and time again voted with and for Trump. Speaking more broadly the absolute silence from the GOP, specifically the GOP leadership is deafening.

I am about to say something that you may find offensive, if so I encourage you to stop reading this entry. According to the United States Census data, circa 2010, which reads in part...

 

White population increased at a slower rate than the total population.
The total U.S. population grew by 9.7 percent, from 281.4 millionin 2000 to 308.7 million in 2010.

In comparison, the White alone population grew by6 percent from 211.5 million to 223.6 million.

But while the White alone population increased numeri- cally over the 10-year period, its proportion of the total population declined from 75 percent to 72 percent.

 

Additional data can be viewed on pages 5 & 6 of the US Census 2010 Report. And while people like myself and many of my neighbors understand and genuinely like the changes in the US popular, because it’s proving America is an amalgam of many races and cultures. The problem is people like Donald Trump only see a White aka Pure America. 

...number of Whites who reported one race and identified as Hispanic was 26.7 million, or 9 percent of the total population. In comparison, the num- ber of Whites who reported one race and identified as non-Hispanic numbered 196.8 million, or 64 per- cent of the total population.

Among the 7.5 million people who reported White in combination with an additional race group(s), 2.4 million were Hispanic. Multiple- race White respondents who were of Hispanic origin represented
1 percent of the total population.

 

The actual reality is our America is a beautiful tapestry of various colors and cultures. Yet somehow Donald Trump continues to tap in to the UGLY underbelly of America. The older baby boomer generation but he’s also with a wink and nod tapping into the current “college” age generation. Which is frightening because I do not think my peers understand that the White Nationlist and White Supremacist have tapped into the “preppy college kid” population.

In February of 2018 the ADL published a new report, which focused on the precipitous increase of College Campus White Supremacist Propaganda. The ADL followed up their February report with their June 28, 2018 report, which noted a  77% INCREASE in White-Supremacist Propaganda on College Campuses.

 

 During the 2017-18 academic year, the ADL’s research arm, the Center on Extremism, recorded 292 instances of white-supremacist propaganda on campuses. That’s a 77-percent increase from the 165 cases it documented in the 2016-17 academic year.

 

Honduran Plaintiffs file a Class Action re Trump’s TPS termination 

 

So it should not come as a surprise that a Group of Hondurans filed a 32 page complaint.

President Trump continues to abuse the law, including constitutional rights, to deter Central Americans from exercising their lawful right to seek asylum in the United States, and the fact that innocent children are involved matters none to President Trump.

Trump’s policy position/initiative is to put these very children in tents, touting that “when they find out this happens, [held in tents for years in the desert] you’re going to have far fewer people come up.” Clearly President Trump cannot believe that his tents are facilities run by licensed programs as required by the
Flores Agreements. And President Trump clearly is not talking about adequate temperature controlled and ventilated tents with toilets and sinks and drinking water, for Plaintiffs’ children, noting that Trump has condoned tent encampments as recent as 8 months ago

 

On pages 5 and 6 I read it and literally was stunned not just because it’s factually correct but reading it as a whole versus the nonstop sewage and lies spewing from Trump’s mouth it just shows how much of an authoritarian dolt he is, Trump is drunk on power and he’s hell bent on reshaping what we in America consider American. Frankly it is stunningly racist AF:

 

President Trump has begun hysterically asserting without any evidence that “many criminals” and “many gang members” are in this “onslaught” of migration. In an effort to create fear and hysteria, Trump has gone so far as to call this “an invasion of our Country.”

Despite these statements and actions, Trump has been unable to produce any evidence of criminals and gang members within the caravan, which has largely proceeded peacefully on its journey. Plaintiffs now request that this Court declare Trump’s policy positions/initiatives outlined in this Complaint unconstitutional, to end this case and controversy. (emphasis added)

 

The LAW allows for those seeking Asylum are entitled to a “credible fear hearing” the FACTS show that Donald Trump, AG Jeff Sessions and DHS Sec Nielsen have repeatedly changed the “rules of engagement” making those seeking Asylum or continue receiving TPS protection harder. In fact we know that earlier this year AG Sessions 

 

Rightfully so the Plaintiffs point to the legally binding Flores Agreement. Last month I walked you through the Notice of Proposed Rule Making regarding Trump’s intented plan to gut the Flores Agreement and TVA. Entry found here.

 

 

Given the success of the previous TPS Complaint (Romez v Trump et al) it actually makes  a lot of sense that this Complaint focuses on the Trump Administration’s ongoing and compounding violations of law and in particular the Flores Amendment.

 “we’re going to take the people and they’re going to wait … when they find out this happens, you’re going to have far fewer people come up.” This demonstrates that Trump is compounding violations of the Flores Agreement by again attempting to use immigration detention as a deterrent to migration, again flouting this Court’s ruling that this is unlawful.

I often find that Donald Trump has no idea what public policy is nor does that incompetent race baiting, hate filled incompetent “president” time and time again has his ass handed to him by our Judicial Branch. Trump and his cabal like to chant “lock her up” we are “the rule of law party” when at every turn these people ignore the laws or simply think with a stroke of Trump’s gilded Sharpie that he can just create new laws via Executive Order. I am fairly certain a nine year old with a basic comprehension of American Civics know more about the 3 CO-EQUAL branches of Government or how a bill becomes law. Yet time and time again Donald Trump thinks he’s a goddamn “king”

 

The portion of the Plaintiff’s complaint stuck out to me, by LAW those seeking asylum have a right to seek it. But Trump and his policies which are drowning in racial animus not only empede the Asylee’s claim but also frustrate their attempts to lawfully seek asylum:

 

 

Any immigrant, even one deemed inadmissible under §§ 1182(a)(6)(C) or 1182(a)(7), who indicates an intention to apply for asylum or a fear of persecution, shall be referred to an asylum officer. 8 U.S.C. § 1225 (b)(1)(A)(ii). 


Thus, the Defendants are attempting to deprive these migrants of their statutory right to seek asylum, and utilizing the U.S. military against desperate, unarmed, women and children to do it

Specifically, upon information and belief, the Defendants have issued an informal directive to all CBP officers to select “arriving alien” for all of the Plaintiffs to subject them to mandatory detention. In Kim, the Supreme Court acknowledged that § 1226 (emphasis added)  

 

The due process claims are incredibly strong as are the APA and statuary claims for asylees but again this Complaint just further highlights the brazenness and callousness of Donald Trump and his utter incompetent DHS Secretary and yes his Attorney General. The issue is Trump believes he is above the law and he can say and do what ever the ____ he wants. Ironic given he touts the “I am the Law and Order” but the reality is Trump did in fact say the Military can and will be armed and “take appropriate action” and YES Trump never said they should shoot but the “intent” is clear and present. 

 

 

detaining caravanners, including Asylum seekers, until they are deported back to Central America prohibits those seeking Asylum from challenging their inclusion within the category of aliens that must be mandatorily detained as described in the immediate two above paragraphs.

Trump is the ONE who promotes violence  

 

 

At any rate I’d keep an eye on this Complaint because both on substance and merits it’s clearly a strong Complaint. That said I wish someone in the media would research the cost to tax payers, from my non scientific recollection there have been dozens of lawsuit, with a vast majority citing the APA or other various shortcuts, at one point I assume that Donald Trump will understand that White/Black/Yellow/Brown/Purple Americans are fed up with his nonstop pathological lying, his narcissistism, his inability to show a modicum of decency, and the never ending verbal abuse.

Is Donald Trump a narcissist? YES 

 I am not a medical expert, according to the Mayo Clinic they define the symptoms of a narcissist as:

  • Have an exaggerated sense of self-importance ✔️
  • Have a sense of entitlement and require constant, excessive admiration✔️
  • Expect to be recognized as superior even without achievements that warrant it✔️
  • Exaggerate achievements and talents✔️
  • Be preoccupied with fantasies about success, power, brilliance, beauty or the perfect mate✔️
  • Believe they are superior and can only associate with equally special people✔️
  • Monopolize conversations and belittle or look down on people they perceive as inferior✔️
  • Expect special favors and unquestioning compliance with their expectations✔️
  • Take advantage of others to get what they want✔️
  • Have an inability or unwillingness to recognize the needs and feelings of others✔️
  • Be envious of others and believe others envy them✔️
  • Behave in an arrogant or haughty manner, coming across as conceited, boastful and pretentious✔️
  • Insist on having the best of everything — for instance, the best car or offic✔️

Mayo Clinic goes on to explain how narcissist “deal” with criticisms and how they react to what they think are unfair or baseless criticism. When you look at Trump as in the “whole” Trump a clear picture comes in to focus:

  • Become impatient or angry when they don't receive special treatment
  • Have significant interpersonal problems and easily feel slighted
  • React with rage or contempt and try to belittle the other person to make themselves appear superior
  • Have difficulty regulating emotions and behavior
  • Experience major problems dealing with stress and adapting to change
  • Feel depressed and moody because they fall short of perfection
  • Have secret feelings of insecurity, shame, vulnerability and humiliation 

So next Tuesday vote accordingly because I know as long as the GOP Controls the House and/or the Senate they will never ever perform their constitutional job of being the check and balance on an Executive who’s power hungry and has no respect for Rules or the Law. In summary if you want the continued corruption, unethical Cabinet, the unjust enrichment essentially Trump stealing from the American tax payers, fine vote Republican but I’d rather vote for a party that actually cares about everyone versus a political party that only cares about making Trump happy & richer.
