...with the actual Jury Verdict Sheet which awarded that Alva Pilliod and Alberta Pilliod $2 billion in punitive damages to Mr & Mrs Pilliod, both of whom were diagnosed with non-Hodgkin’s lymphoma. after using Monsanto’s Roundup herbicide product in their home garden/laws over the course of 30 years.
The question of Monsanto’s failure to warn is intriguing and I suppose played in to the rationale of monetized damages...

(Reuters) California jury on Monday awarded more than $2 billion to a couple who claimed Bayer AG’s glyphosate-based Roundup weed killer caused their cancer, in the largest U.S. jury verdict to date against the company in litigation over the chemical.
Glyphosate - RoundUp = Cancer?
On March 20, 2015 The World Health Organization’s (WHO) International Agency on Cancer Research (IARC) published:
IARC Monographs Volume 112:
evaluation of five organophosphate insecticides and herbicides
“...has assessed the carcinogenicity of five organophosphate pesticides.”
A summary of the final evaluations together with a short rationale have now been published online in The Lancet Oncology, and the detailed assessments will be published as Volume 112 of the IARC Monographs.
With respect to Glyphosate IARC’s elevation, reads in part:
For the herbicide glyphosate, there was limited evidence of carcinogenicity in humans for non-Hodgkin lymphoma. The evidence in humans is from studies of exposures, mostly agricultural, in the USA, Canada, and Sweden published since 2001.
In addition, there is convincing evidence that glyphosate also can cause cancer in laboratory animals. On the basis of tumours in mice, the United States Environmental Protection Agency (US EPA) originally classified glyphosate as possibly carcinogenic to humans (Group C) in 1985. After a re-evaluation of that mouse study, the US EPA changed its classification to evidence of non-carcinogenicity in humans (Group E) in 1991. The US EPA Scientific Advisory Panel noted that the re-evaluated glyphosate results were still significant using two statistical tests recommended in the IARC Preamble.
The IARC Working Group that conducted the evaluation considered the significant findings from the US EPA report and several more recent positive results in concluding that there is sufficient evidence of carcinogenicity in experimental animals. Glyphosate also caused DNA and chromosomal damage in human cells, although it gave negative results in tests using bacteria. One study in community residents reported increases in blood markers of chromosomal damage (micronuclei) after glyphosate formulations were sprayed nearby.
In the spirit of full transparency, after this March 2015 WHO/IARC Report, other WHO sub-Agencies published reports that contradicted IARC’s March 2015 classification. In addition to that intra-WHO scientist infighting, it’s worth noting that the scientific data regarding Glyphosate and its derivative compounds are numerous scientific and medical reports that say Glyphosate is a carcinogen and Glyphosate is NOT a carcinogen. All of which can and is very confusing.
I suppose the hundreds of pro/con report regrading Glyphosate can in some respects be rationalized by who/what/how/why/when Monsanto has paid/Commissioned to those in the scientific and medical field for their “expertise”
This is the National Institutions of Health Database, you can run a general search for Glyphosate. Link found here. At present there are in excess of 2,800+ medical publications.
It is worth noting that in 1985 the Environmental Protection Agency (EPA), originally classified Glyphosate “as a carcinogen” more specifically a Group C chemical (Possible Human Carcinogen), but keep in mind this is actually Standard Protocal for any NEW “application”. This is the default classification when there is limited to zero scientific or medical evidence/studies/research.
However in 1986 the EPA re-evaluated their original classification. In September of 2016 the EPA published a report, found here.
And because I believe in transparency, understanding the WHOLE picture and yearn for unbiased knowledge, in early 2018 Monsanto Commissioned their own “Report” the timing of this should be scrutinized.
Why? Most people will ignore the date of Monsanto’s “report” the original publication date was June 2016 (3 months before the EPA’s 2016 Report) yet Monsanto waited until July 2017 to make this report available on its website. Which is odd given (FIRED) EPA Administrator Pruitt did in FACT and with some regularity meet with Monsanto, repeated in 2017 & 2018. Link to Monsanto’s report can be found here.
Also because insecticides and herbicides are strictly regulated IF there are any proposed changes and rule making by ANY Government Agency, there are mandatory Notice and Comment requirements, see EPA’s Glyphosate Docket, link found here.
And YES of course in reviewing the 229K plus “public comments” there’s a predictable pattern, as in it sure seems like a lot of dead people have a LOT of favorable things to say about Monsanto & Glyphosate. This link will take you to the Government Regulations Page, I did notice something odd, I suppose when Fired-Pruitt submitted this proposed NEW rule making he aggregated the public comments, meaning the public comments are not centralized but aggregate to each “study/report” of which there are 56 attached to this particular docket. ORIGINAL 2016 MONSANTO v DEWAYNE JOHNSON
One thing that’s overlooked by most in the MSM is they fail to report some baseline facts that we should ALL know as it relates to Monsanto, RoundUp, RoundUp-Ready Seeds and potential human health risks. See original 2016 Complaint found here. For example:
- In 2001 85-90 million pounds of Glyphosate sold via RoundUp
- In 2006 that figure grew to an astounding 185 million pounds.
- When herbicides like Glyphosate are sprayed, where does that chemical go?
- It’s retained in the Crops sprayed & WHAT we eat
- The run off, means Glyphosate leaches into the ground water
- Thus we all bathe, brush our teeth and drink water containing Glyphosate. See NIH report.
- In 2009 Monsanto held 27% of marketshare in RoundUp ready seeds
- 2010 Monsanto controlled 70% of marketshare of corn & cotton seeds
- 2010 Monsanto controlled 90% of Soybean seeds (see twitter thread below)
A cursory internet search you will fund countless lawsuits, class action lawsuits and whole websites dedicated to fighting Monsanto and RoundUp. You can read the actions, here, here...in fact in 2016 California “centralized” numerous Monsanto/RoundUp lawsuits, Judge’s 2016 Order found here.
And for the record the firms listed in the 2016 Transfer Order are not tiny bouquet law firms, they are literally the law firm Goliaths. Please do not infer the aforementioned comment as a slight or shade on small law firms. When cases are combined and/or transfered the underlying motive is Judicial Economy and Efficiency. That said in the aforementioned 2016 Transfer Order:
IT IS THEREFORE ORDERED that the actions listed on Schedule A and pending outside the Northern District of California are transferred to the Northern District of California and, with the consent of that court, assigned to the Honorable Vince Chhabria for coordinated or consolidated pretrial proceedings.

Which then lead to dozens of motions, but the First Amended Complaint really encapsulated the purported “injury”. Essentially Monsanto and RoundUp knew about the possibly adverse side effects of Glyphosate and its potential causation and linkage to non-Hodgkin lymphoma. Judge Chhabria currently oversees 400+ lawsuits. In the late evening of July 10, 2018 (it was after 11PM my time, remember I’m in the DMV area) his 68 page Order & Opinion was and should be thought of as a seismic shift. I’m pretty sure the big wigs at Monsanto literally lost their marbles and I am pretty sure it was this sentence (again in legalese words matter):
“..question is whether they have offered opinions that would be admissible at a jury trial.”
This is one of the most concise reasons and rationale I’ve read in a while.
It’s a close question whether to admit the expert opinions of Dr. Portier, Dr. Ritz, and Dr. Weisenburger that glyphosate can cause NHL [Non-Hodgkin’s Lymphoma] at human-relevant doses. Therefore, it’s a close question whether to grant or deny Monsanto’s motion for summary judgment. But the Court concludes that the opinions of these experts, while shaky, are admissible.
In Judge Chhabria’s 68 page Order, he takes greats pains and care to recognizes that the Plaintiffs expert witness testimony/declarations and evidence supporting Glyphosate - may- have a like and causation to certain forms of cancer, but the Judge also expressed that the Plaintiff’s evidence-link may be weak. Notwithstanding the Judge goes on to acknowledge the Plaintiffs evidence is l substantial enough for the hundreds of lawsuits regarding Roundup and any-link to various cancers to move forward.
In simpler terms think of the David & Goliath story. In this case the Plaintiffs are David and Monsanto is the Goliath and the Plaintiffs caught a break.
Therefore, the plaintiffs have presented evidence from which a reasonable jury could conclude that glyphosate can cause NHL at human-relevant doses. Monsanto's motion for summary judgment is denied.
So imagine, if you will, upon reading this docket, various filings my suprise to literally stumble upon the Soybean & DOJ connection. Then imagine doing a LexisNexis Search and finding my own June 2018 thread regarding the aforementioned Monsanto-Bayer- Soybean RoundUp ready seeds and how they genetically modified soybean seeds, thus rusting in almost a locked in monopoly.
-cough- you do understand part of the Justice Department’s role is anti-trust and watching megers to ensure they do not violation Anti-Trust statutes, right?
