Immigration and Trump a study in hypocrisy

Posted on July 09 2018

For a man who’s the self professed “though on immigration” and “strong borders” the man certainly uses the VISA process to procure seasonal employees of his various properties.

On July 5, 2018 via US Department of Labor (DOL), Donald Trump’s Mar-a-Largo applied for dozens of Visa, this application alone asking for 40 immigrant workers. Visa and Job posting via this DOL work order, link found here.

See below the fold for the DHS & DOL Notice of Rule making.

Essentially based on the May 2018 Federal Register Notice, Trump is telling the government there are ZERO Americans who can fulfill the 40+ waiter/waitress positions. You do see that’s problematic, right?

12.68/hr minimum; overtime possible but not guaranteed @ $19.02/hr.

Raises and/or bonuses may be offered to any worker in the specified occupation at the company's sole discretion based on individual factors, including work performance, skill or tenure.

A single workweek is used to compute wages due, wages paid bi-weekly.

But that’s NOT the only DOL HB2 visa request and positions. The same day the Trump’s Maralargo filed for 40 waiter/waitresses, they ALSO filed for 21 HB2 visa for cooks. Link to Maralargo’s additional HB2 Visa request can be found here.

And it’s NOT just Trump’s Maralargo, his son Eric Trump jumps on the DOL Visa train too. See Trump Winery’s January 2018 application for 23 position. Also as of today this application defaulted to: Inactive. You can read the original Visa application for Trump Winery via this DOL link, found here

11.46 to per Hour

Please note, in light of the Department of Labor's position that where an employer has staggered dates of need, the employer must file a separate application for each date of need, Trump Vineyard Estates, LLC has already filed one or more earlier applications reflecting a portion of their regularly recurring cumulative labor need

See Trump Winery 33 page amended HB2 Visa application, found here

And YES the DOL approved 6 additional Visas for Trump Winery, see 10 page DOL certification, link found here. I refer you to pages 1-3 and specifically pages 9 & 10.

Pursuant to the May 2018 Federal Register Notice:

...”has decided to increase the numerical limitation on H–2B nonimmigrant visas to authorize the issuance of up to an additional 15,000 through the end of Fiscal Year
(FY) 2018....”

...nonagricultural temporary worker having a residence in a foreign country which he has no intention of abandoning who is coming temporarily to the United States to perform . . . temporary [non-agricultural] service or labor if unemployed persons capable of performing such service or labor cannot be found in this country.’’ INA section 101(a)(15)(H)(ii)(b), 8 U.S.C. 1101(a)(15)(H)(ii)(b). Employers must petition DHS for classification of prospective temporary workers as H–2B nonimmigrants. INA section 214(c)(1), 8 U.S.C. 1184(c)(1).

FY 2018 Omnibus On March 23, 2018, the President signed the FY 2018 Omnibus:

...which contains a provision (section 205 of Division M, hereinafter ‘‘section 205’’) permitting the Secretary of Homeland Security, under certain circumstances and after consultation with the Secretary of Labor, to increase the number of H–2B visas available to U.S. employers, notwithstanding the otherwise established statutory numerical limitation.

Specifically, section 205 provides that ‘‘the Secretary of Homeland Security, after consultation with the Secretary of Labor, and upon the determination that the needs of American businesses cannot be satisfied in [FY] 2018 with U.S. workers who are
willing, qualified, and able to perform temporary nonagricultural labor,
’’ may increase the total number of aliens who may receive an H–2B visa in FY 2018 by not more than the highest number of H–2B nonimmigrants who participated in the H–2B returning worker program
in any fiscal year in which returning workers were exempt from the H–2B numerical limitation. This rule implements the authority contained in
section 205.  (Emphasis added)

So remind me again on how “tough” Donald J Trump is on immigration, because since 2000 Trump’s businesses  have “employed” thousands of Immigrants via the HB2 Visa application. Hypocrite Much Donald? I see you and know you’re a liar and a fraud..

see 2015 Reuters Exclusive & Exhaustive Article regarding Trump & his Companies and Visas. Article found here

Trump owns companies that have sought to import at least 1,100 foreign workers on temporary visas since 2000, according to U.S. Department of Labor data reviewed by Reuters. Most of the applications were approved, the data show.

Nine companies majority-owned by Trump have sought to bring in foreign waitresses, cooks, vineyard workers and other laborers on temporary work-visa programs administered by the Labor Department.

The candidate’s foreign talent hunt included applications for an assistant golf-course superintendent, an assistant hotel manager and a banquet manager

Two of his companies, Trump Model Management and Trump Management Group LLC, have sought visas for nearly 250 foreign fashion models, the records show.

Should the MSM want to dive deeper into this hypocrisy, Reuters identified the following Trump Business, here I ran a cursory DOL Search for you, link found here.

    • Jupiter Golf Club
    • Lamington Farm Club LLC
    • Trump Miami Resorts Management LLC
    • Trump National Golf Club LLC
    • Trump Payroll Chicago LLC
    • Trump Vineyard Estates LLC.

Litterally Trump is a hypocrite and a proven pathological liar. It would not surprise me if this gets ignored by the media but I’m just FED up with the alarming hypocrisy and how Trump uses the immigrant community has a political birdie he feels entitled to abuse and vilify.

Can we stop pretending now?

Here’s a long list of Trump’s:
