This ODNI Fact Sheet is a worthwhile read, it provides you with historical data, the evolution of this critically important agency.  As you might recall in January of 2017 the ODNI issued the following collaborative report entitled:

There is zero argument or fuzz - Russia “sweeping and systematic” interference in our 2016 Election. This is further expounded by last week’s Senate Intelligence Committee Report

To understand the totality of inter/intra Agency work flow of the ODNI - it’s important identify the various sectors and disciplines but it’s also  important to fully understand what the DNI is responsible - Congress has provided the DNI with a multitude of authorities and duties, including to:

Ensure that timely and objective national intelligence is provided to the President, the heads of departments and agencies of the executive branch, the Chairman of the Joint Chiefs of Staff and senior military commanders, and the Congress.

Establish objectives and priorities for collection, analysis, production and dissemination of national intelligence.

Ensure maximum availability of and access to intelligence information within the Intelligence Community.

Develop and ensure the execution of an annual budget for the National Intelligence Program based on budget proposals provided by IC component organizations.

Oversee coordination of relationships with the intelligence or security services of foreign governments and international organizations.

Ensure the most accurate analysis of intelligence is derived from all sources to support national security needs.

Develop personnel policies and programs to enhance the capacity for joint operations and to facilitate staffing of community management functions.

Oversee the development and implementation of a program management plan for acquisition of major systems, doing so jointly with the Secretary of Defense for DoD programs, that includes cost, schedule, and performance goals and program milestone criteria.

 

 

ODNI's NATIONAL INTEGRATION CENTERS

 

“The Intelligence Community maintains several national centers that integrate and coordinate the activities of the entire IC, or in some cases, broader U.S. Government activities.  At ODNI these include the

 

National Counterterrorism Center: Core focus of “analyzing, understanding and responding to terrorist threats”

 

We lead and integrate the national counterterrorism (CT) effort by fusing foreign and domestic CT information, providing terrorism analysis, sharing information with partners across the CT enterprise, and driving whole-of-government action to secure our national CT objectives.

 

National Counterproliferation Center: Core focus weapons of mass destruction.

 

We lead the Intelligence Community and interagency to prevent the proliferation of weapons of mass destruction, their delivery systems, related technologies and expertise.

 

 

National Counterintelligence and Security Center - in my opinion this is one of, if not the most important division within the ODNI.

Lead and support the U.S. Government’s counterintelligence (CI) and security activities critical to protecting our nation; provide CI outreach to U.S. private sector entities at risk of foreign intelligence penetration; and issue public warnings regarding intelligence threats to the U.S.

 

I personal found their NATIONAL INSIDER THREAT TASK FORCE MISSION FACT SHEET of most interest. As the first paragraph reads:

The National Insider Threat Task Force (NITTF) was established after the WikiLeaks release of thousands of classified documents through the global media and internet. Its mission is to deter, detect, and mitigate actions by employees who may represent a threat to national security by developing a national insider threat program with supporting policy, standards, guidance, and training.

 

Cyber Threat Information Integration Center

CTIIC is the federal lead for intelligence support in response to significant cyber incidents, working—on behalf of the IC—to integrate analysis of threat trends and events, build situational awareness, and support interagency efforts to develop options for degrading or mitigating adversary threat capabilities.

 

About ten days ago the ODNI via DNI Coats issued, ODNI News Release No. 22-19


Director of National Intelligence Daniel R. Coats Establishes Intelligence Community Election Threats Executive


Director of National Intelligence Daniel R. Coats today announced he established the position of Intelligence Community (IC) Election Threats Executive (ETE) and appointed Shelby Pierson to serve in this new role.

The ETE will serve as the DNI’s principal adviser on threats to elections and matters related to election security. Additionally, the ETE will coordinate and integrate all election security activities, initiatives, and programs across the IC and synchronize intelligence efforts in support of the broader U.S. government.

 

In short the DNI and ODNI play a critical role in collecting, analyzing, and recommending actions to protect our National Security and they act as a liaison to our vast Intelligence Community (both Civilian and Military agencies) . It is not an agency that should be weaponized by “nominating” an obsequious Trump-Sycophant. The DNI must put their partisan inclinations aside, remain loyal to the truth and facts and swear an oath to our Constitution, not Donald J Trump.

 

Insofar as DNI Coats - he embodied the character, seriousness, intellectual capacity and pragmatic actions we should all expect for our DNI. Trump nominating Ratcliffe is akin to letting the arsonist run the fire department and it should worry you, a lot. This ODNI link will take you to DNI Coats’ resignation letter. I will admit that in the beginning I wasn’t exactly a supporter of Coats. I largely remained silent because I wanted to see how he would perform in this very important role. What troubles me is the Trump Administration appears to be scraping the bottom of the swamp with Radcliffe’s nomination. And yes I’m saying Trump can not retain or attract the “best of the best” instead he gets third and fourth string “players” - who’s only prerequisite qualification is their never ending “loyalty” to Trump. Frankly it’s exhausting and worrisome.

 

 

John Ratcliffe

too partisan to lead the ODNI 

 

 For me what’s most concerning is Rep Ratcliffe’s inappropriate “conversations” with the Department of Justice Inspector General. As standard protocol it’s highly unusual for a sitting House subcommittee on Homeland Security to announce the status of a DOJ-OIG FISA Investigation. Only July 2, 2019 the Trump-Trifecta simulcast from the Mother Ship - colloquially known as Trump-Fox News.

 

 

In this farcical TV News segment: “Deep State Abuse of Power” Ratcliffe discloses that during the last week of June 2019 :

“I did have the opportunity to meet with Inspector General Horowitz last week...We talked about his report, the timing of his report, not the content, and he related that his team’s investigative work is complete,”

Ratcliffe went on to say:

“They are now in the process of drafting that report. And that “he” (not the DOJ-OIG) expects that the report will:

 

“be completed in short order...I will tell you though...I don’t expect that any of us will see [the report] real soon. [Horowitz] did relate that as much as 20 percent of the report is probably going to include classified information.”

 

This type of undue political influence and inappropriate “conversations” could lead to even more polarized political discourse and further degradation of the public’s trust and confidence of the Department of Justice. Until the Trump administration even if I personally disagreed with the DOJ - I still held a decent amount of respect, trust and confidence of their impartiality. Conversely under this cloud of corruption, equivocation and weaponization of DOJ - We now find ourselves at a crossroad. When it comes to the DOJ, Trump has installed his new “Roy Cohn” that Trump continues to improperly use the DOJ as a weapon to attack his perceived political foes.

Lest we forget  the June 2019 DOJ Complaint against Omarosa:

for civil penalties for knowingly and willfully failing to file the required public financial disclosure report after her employment terminated with the Executive Office of the President

 

 

Ratcliffe Deep State Conspiracies

 

 

During last week’s Mueller Testimony aka RATcliffe’s job audition, he clearly pleased the “audience of one” - it should also be noted his failed cross examination of Mueller is oddly reminiscent of AUSA Ratcliffe’s pathetic prosecutorial job performance.

 

 

So as with my standard practice I will embed original links to documents. As many of you are well aware disinformation has ramped up and I personally believe it’s critical to “show your homework” - full disclosure I have zero intention of doxing Rep Ratcliffe. Therefore I’ll only link to the Federal Elections Committee’s “raw data” versus publishing the individual pages - which list his home address.

Rep Ratcliffe FEC Loans and loan repayments circa 2013 to present. I should note that there’s nothing illegal or unethical about you as a candidate loaning your Congressional Campaign money. Again that link will take you to the raw FEC data.  I’ve taken the liberty of sorting said receipts. For example in 2018 I found that Ratcliffe’s Congressional Campaign repaid 

 

See July 2018 FEC Form 3 Report, specifically page 53 - again do not dox him. Take the time to properly redact his home address. Only losers and intellectually stunted opt to dox people.

 

Now let’s turn to Representative Ratcliffe’s Annual Financial Disclosures - Members of Congress are required to report their assets and liabilities. What I found interesting is under the “liabilities”

I now refer you to page 5 of his 2014 New Filer Submission. The reason I’m bringing this to your attention is this gives you a provable baseline of his finances. Meaning at the time of this 2014 filing he had the following liabilities:

September 2013 - FlagStar Bank - Mortgage $200-$500K

May 2014 - Nationwide Bank - “line of credit” $50-$100K

 

 

Subsequently thereafter 2015 to present his Mortgage is no longer listed as a liability - yet his two credit cards (Visa and American Express, respectively) balances remain the same over this four year period. Which genuinely makes me wonder the following: was his Mortgage paid off? why didn’t he disclose his campaign loan? His spouse also saw a sizable increase in her salary $120K to $150K circa 2015 (see page 2 of each financial disclosure report).  

According to this April 2018 Congressional Research Service White Paper, Members of the House earn a salary of $174,000 per year. They also granted what’s known as a Members’ Representational Allowance - with an average MRA  of $1,315,523. - keep in mind that the MRA’s pay the staffers salaries, travel related expenses. Which brings the annual gross income for the Ratcliffe to approximately $324,000.00 by comparison the median income for Rockwall, TX is $93,269.00 - at least according to recent US Census Data, See US Census interactive data below.

 

 

 

But sometimes it is best to go back to the beginning of Ratcliffe’s journey to DC - See his 2013 Congressional Campaign Lit (also archived here). I also believe in being fair - as such I’ve culled a few DOJ Archives. It’s important to note that Ratcliffe’s Congressional Campaign lit - one could argue that he overly embellished the following:

Operation Icebox (Internet Archive found here):

an investigation began in January 2003 revealing a drug distribution conspiracy involving over 500 grams of methamphetamine.  A federal indictment was returned in September 2006 charging Pena and three co-defendants with federal drug violations. 

 

Operation Plymouth Rock - I like to think I’m semi-decent in researching various topics. I ran multiple searches in multiple databases (WestLaw, LexisNexis, Congressional Law Library and the Justice Department Archive) - I went so far as to run multiple searches via the EDTX-DOJ website.  Ratcliffe also states he put “Terrorist in jail” but I can’t find a single case where he prosecuted a “terrorist” what’s also odd is Ratcliffe states in clear terms that he was appointed as Bush II’s Chief Terrorism Division in the EDTX - but every Archive I searched came up with nothing. As in no formal announcement from the archived Bush White House or from the Department of Justice. 

 

On April 16, 2008, “Operation Plymouth Rock” led to the successful prosecution of hundreds of illegal aliens who committed identity theft and social security fraud to unlawfully gain employment. As the result of John’s efforts, the company, which hired the illegal aliens, paid a $4.5 million criminal penalty.

 

Moreover currently on Ratcliffe’s Congressional Page he actually states (which is categorically false). This isn’t me arguing on the margins, last I checked the AUSA has never personally cuffed and stuffed a criminal. That task is apportioned to Law Enforcement. Conversely yes of course in Ratcliffe’s 13  month tenure as the “Acting” EDTX AUSA he prosecuted cases but it’s clear on Ratcliffe’s current Congressional “official” biography page he states in unequal terms that  “I arrested over 300 illegal immigrants” that’s a lie, a blatant lie and I don’t know what else to call it besides a lie.

 

As a U.S. Attorney, I arrested over 300 illegal immigrants on a single day, and as a former terrorism prosecutor I know the threats an unsecured border can bring to our national security. I’ve been fighting to lock down our borders and will continually oppose any form of amnesty for those who continue to break our law 

 

Ratcliffe appears to have overly embellished the Operation Plymouth Rock which was a multi-jurisdictional raid by ICE in five different states, ICE agents made early-morning raids in Mount Pleasant; Batesville, AR.; Live Oak, FL - Chattanooga, TN and Moorefield, WV./. Moreover the raid of Plymouth Poultry was a multi year Enforcement endeavor. Ratcliffe said authorities were working to ensure that any children of detained workers were getting proper care. Texas Child Protective Services spokeswoman Shari Pulliam said the agency was notified about the raid but has not had to take custody of any children.

"I hope that the message from today's operation is clear," Ratcliffe said. "We are intent on stopping immigration fraud and identity theft and we will aggressively prosecute anyone who uses another person's name or Social Security number for the purpose of working illegally in this country."

 

And let’s not forget that in November of 2018 Ratcliffe was “purportedly” on the short list as an Attorney General replacement. Irrespective of Ratcliffe’s qualifications, more precisely he literally has next to zero as it relates to our Intelligence Community, he doesn’t take election security seriously.

 

Meet 2011 Major Ratcliffe

To give you an idea of how small the City of Heath Texas is - according to the July 2018 (projected) US Census Data it has a total population of 8,953 yet somehow Trump thinks Ratcliffe has the prerequisite veritas to lead one of our Country’s most critical and  forward facing Agencies. Hell to the no. Ratcliffe is a Trump sycophant who just might be worse than any other Trump nominee - and that’s saying a lot.

 Ratcliffe’s Congressional Legislative Record is - interesting, especially the cyber security and immigration bills. Should we tell Trump that Ratcliffe worked for Romney’s Transition Team and helped vet potential nominees? In short being nominated as our Country’s next DNI is a serious and consequential job - not one to be given to a horribly unqualified partisan “Yes Man” such as Representative Ratcliffe - but then again Trump doesn’t really take his job seriously or our Country’s National Security.

Last week I flippantly joked that Trump would grant Madoff his clemency request and shortly thereafter name good ol’ Bernie Maddoff as the next Fed Chairman. At this point it may not be a joke. Given Trump just nominated Ratcliffe who’s resume is thinner than a fine thread of silk. Seriously the ODNI is like the crown jewel of our Country’s Intelligence Community - yet Trump cheapens it with this nomination. God Help Us All - SpicyFiles Out

 

RATcliffe DNI Post opts out of consideration

 

At this point none of you should be surprised that Ratcliffe withdrew his nomination.  Nor should you be surprised that Trump made the announcement via Twitter and subsequently went off on the South Lawn in an oddly subdued screed

 

Someone really should forward Trump a copy of Black’s-Law Dictionary - because it is clear that Trump doesn’t understand what “libel” or “slander” is.

LIBEL

Defamatory statement published through any manner or media. If intended to simply bring contempt, disrespect, hatred, or ridicule to a person or entity it is likely a civil breach of law. However, if it causes mayhem or breach of peace, it can be a criminal breach of law. Yet, again, if the statement is newsworthy, even if defamatory, proof of benefit to the public is required to avoid criminal complaint.

SLANDER

In torts. Oral defamation; the speaking of false and malicious words concerning another, whereby injury results to his reputation.

So the media and researchers doing their due diligence by fact checking Ratcliffe’s claims - Mr President reporting facts and verifying statements made by your nominee isn’t libelous. It is not our fault that your nominee clearly over embellished his record as an “Acting AUSA for the EDTX” nor is it our fault that your nominee made up a position and when questioned by CNN -Ratcliffe doubled down by issuing the following statement to CNN:

Ratcliffe spokeswoman told CNN Thursday that Justice Department records would “confirm that as both Chief of Anti-Terrorism and National Security for the Eastern District of Texas from 2004-2008, John Ratcliffe opened, managed and supervised numerous domestic and international terrorism related cases.”

 

Subsequently thereafter Ratcliffe issued a semi-lengthy statement explaining his withdrawal as Trump’s Second DNI. I am also guessing that Moscow-Mitch had a very frank conversation with Trump and likely conveyed that Ratcliffe could not obtain enough Senate Votes to confirm him.

 

 While I am and will remain very grateful to the President for his intention to nominate me as Director of National Intelligence, I am withdrawing from consideration. I was humbled and honored that the President put his trust in me to lead our nation’s intelligence operations and remain convinced that when confirmed, I would have done so with the objectivity, fairness and integrity that our intelligence agencies need and deserve. However, I do not wish for a national security and intelligence debate surrounding my confirmation, however untrue, to become a purely political and partisan issue. The country we all love deserves that it be treated as an American issue.

 

 

But here are the actual issues at hand - Ratcliffe not only (grossly) padded his resume (for the record much of his felonious “padding”) is still up on his actual Congressional Webpage. As the USA-Today’s astute reporter Brad Heath points out, during Ratcliffe’s abbreviated tenure as the Acting AUSA for the EDTX  he had 43 cases designated as “having something to do with terrorism” 

  

 The case was United States v. Kanyayi (4:05-cr-00202) circa 2005 when Ratcliffe was the Assistant AUSA for the EDTX

As you can read the Indictment of Social Security Fraud in violation of Title 42, United States Code, Section 408(a)(7)(B). To say Ratcliffe “put Terrorist in jail” is a gross over embellishment and overtly dishonest.

 

As for Ratcliffe’s claim that President Bush named him “Chief of Anti-Terrorism and National Security in the Eastern District of Texas” - when you search the National Archives of Bush White House - I noticed a few things - had President Bush really appointed John L Ratcliffe as the “chief of anti-terrorism and national security in the Eastern District of Texas” there would undoubtedly be an actual press release  - so it not surprising that the Bush White House Archive yields no such return for the aforementioned position. This is affirmed by Katrina Mulligan’s twitter-thread 

 

 

 

 In short it’s not like we didn’t see the Ratcliffe train wreck careening down the tracks. Although I’m still curious about Ratcliffe’s House Financial Disclosures and the numerous “campaign loans” that he also failed to disclose on his statutorily required annual financial disclosures...as I previously noted:

Rep Ratcliffe FEC Loans and loan repayments circa 2013 to present. I should note that there’s nothing illegal or unethical about you as a candidate loaning your Congressional Campaign money.
